Terms and Conditions

Applicability of the terms and conditions

These General Terms and Conditions (“Terms of Use”, “House Rules”) apply to contracts for the rental of rental objects (“Villa”, “Villas”) for accommodation as well as all services rendered for the Tenant (“Guest”, “Traveller”) other services and deliveries by MARIM d.o.o., Stara Baška 237A, 51521 Punat, Croatia, OIB: 25795775874 ("MARIM", "we", "us", "landlord"). MARIM's services are provided exclusively on the basis of these General Terms and Conditions.

Guest terms and conditions only apply if previously agreed. Deviations from these conditions are only effective if we have expressly confirmed this in writing.

1 Booking and booking confirmation

If we can offer you the villa for the period you want, we will send you written confirmation and the invoice by email or post. The booking is final upon receipt of the booking confirmation and after the deposit has been paid (see Chapter 3 Terms of Payment).

2 Terms of payment

Once the deposit has been received, your booking is valid. The deposit of 20% of the rental contract is due for payment within 14 days after receipt of the booking documents. After the deposit has been paid, the remaining amount is due 14 days before departure. If the payment deadlines are not met, MARIM can withdraw from the contract. Non-payment is considered withdrawal and entitles you to re-letting.

3 Deposit

A deposit of 1000 euros is due as security at the start of the rental period. MARIM undertakes to repay the deposit to the tenant after the keys have been handed over at the end of the rental period. Any additional costs incurred will be charged. The same applies to damage to furnishings, inventory, rooms, outdoor facilities or the building for which the guest and his fellow travelers are responsible. If the damage caused by the tenant is higher than the deposit, this will be retained in full and the excess repair costs will be charged to the guest.

4 Arrival and departure

Villas are available from 4:30 p.m. on the day of arrival. If you arrive after 10 p.m., a surcharge of 100 euros will be charged. The guest receives the information about the reception and the key handover 14 days before arrival by telephone, email or guest app. Claims for damages cannot be asserted if, exceptionally, the villa cannot be occupied punctually at 4:30 p.m. The guest's arrival and departure is his own responsibility and liability.

On the day of departure, the villa must be vacated by 10:00 am. If the guest wishes a late departure, this must be agreed with us beforehand. Late departure without prior agreement will be charged.

If the guest does not appear by midnight on the day of arrival, the contract is considered terminated after a period of 48 hours without notification to MARIM. MARIM or our representative can then freely dispose of the villa. A (proportional) repayment of the rent due to early departure is generally not made.

On the day of departure, personal items are to be removed, household waste is to be disposed of in the bins provided, and crockery is to be stored clean in the kitchen cupboards.

5 Villas

The villas are handed over by us in a neat and clean condition with a complete inventory. If you notice any defects during your stay, the guest is obliged to inform MARIM immediately. The guest is liable for damage caused by him to the rented property, the inventory (e.g. broken dishes, damage to the floor or furniture). This also includes the cost of lost keys.

The inventory is to be treated gently and with care and is only intended to remain in the villas. The moving of furnishings is prohibited. The guest is also liable for the fault of his fellow travelers. Damages caused by force majeure are excluded from this. In the event of use of the villas in violation of the contract, such as subletting, overcrowding, disruption of quiet times, etc., the contract can be terminated without notice and the guest must therefore leave the villa. The rent already paid remains with MARIM.

6 Pets

The accommodation of pets of any kind is strictly prohibited in the villas. If animals are accommodated without the prior consent of the provider, the provider can charge a cleaning fee of up to 1000 euros.

7 Stay

The villas may only be used by the persons named in the booking. In addition, the maximum number of guests in the respective villas must not be exceeded. If the villa is used by more people than agreed, a separate fee of 25 euros per person per night will be charged for them. In this case, MARIM also has the right to terminate the contract without notice.

Subletting and letting of the villa to third parties is not permitted. The guest agrees to the general terms and conditions as well as the house rules of the villas. The declaration of consent takes place with the payment.

In the event of violations of the terms and conditions or the house rules, MARIM is entitled to terminate the tenancy immediately and without notice. There is no legal right to repayment of the rent or compensation.

8 Travel Cancellation

In the event of withdrawal, the guest is obliged to pay part of the agreed price as compensation. A cancellation must be made in writing. The amount of compensation depends on the time up to the day of arrival and is calculated as follows:

9 Cancellation by the landlord

In the event of cancellation on our part, as a result of force majeure or other unforeseeable circumstances (such as an accident involving the host or serious damage caused by storms) as well as other circumstances beyond our control that make fulfillment impossible, liability is limited for reimbursement of costs. In the event of a justified withdrawal, the guest is not entitled to compensation - liability for travel and hotel costs is not accepted. MARIM can withdraw after the start of the rental without observing a deadline.

10 Lessor Liability

MARIM is liable within the scope of the duty of care for the proper provision of the rental property. Liability for any failures or disruptions in the water or power supply, unforeseeable or unavoidable circumstances (e.g. official orders, construction sites, natural or local events) as well as events and consequences of force majeure are hereby excluded. MARIM is not liable for personal belongings in the event of theft or fire.

MARIM is not responsible if the villas cannot be used due to inadequate travel and/or personal documents.

MARIM is unable to provide medical services or emergency care when needed. MARIM is not responsible for any risks, incidents or consequences arising during the stay in the villa and related to health or otherwise deteriorated physical condition.

MARIM is not responsible for the conditions or requirements of third parties who offer a service other than the accommodation service during the stay.

11 House Rules, General Rights and Obligations

(1) The guest is obliged to comply with the house rules. From 10:00 p.m. to 06:00 a.m. the night rest applies. To avoid disturbing neighbors, audio devices should be set to room volume.

(2) For the duration of the rental of the villa, the guest is obliged to keep windows and (sliding) doors closed when leaving the facility.

(3) There is a general smoking ban in the villas. In the event of violations, you may be charged a cleaning fee of up to 1000 euros. Smoking is only allowed on balconies and terraces.

(4) Use of the entire facility including all facilities and areas (e.g. pool, whirlpool, sauna, beach, fitness equipment) is at your own risk. Parents are responsible for their children.

(5) The installation of decorative materials or similar is not permitted in the villa. The guest is solely liable for any decorations or similar that are included and/or attached. The guest is also obliged to compensate for damage caused by the installation and/or attachment of decorations or similar.

(6) MARIM has a right of access to the villa at all times, especially in the event of imminent danger. Reasonable consideration must be given to the guest's interests worthy of protection when exercising the right of access. We will inform the guest in advance about exercising the right of access, unless this is unreasonable or impossible under the circumstances of the individual case.

12 Final Provisions

The guest agrees that necessary data about the travelers will be stored, changed and/or deleted as part of the contract concluded with him. All personal data will be treated with absolute confidentiality.

Photos and text on the website or in the flyer serve as a realistic description. 100% match with villas cannot be guaranteed. MARIM reserves the right to make changes to the equipment (e.g. furniture) provided they are equivalent.

Should one or more provisions of these terms and conditions be or become invalid, this does not affect the validity of the remaining conditions. The ineffective provision is to be replaced by an effective one that comes as close as possible to the economic and legal will of the contracting parties. The Commercial Court of Rijeka is responsible for any disputes arising from the contractual relationship.
